This Terms of Use Agreement (the "Agreement") constitutes a legally binding agreement between 3am Studio ("3am Studio", "we", "us", or "our") and the client, whether personally or on behalf of an entity ("Client", "you", or "your"), with regard to access and use of our landing page design services and our website.
3am Studio provides Landing Page as a Service. For a fee of $990, you receive one landing page Figma design and one week of revisions.
All design work created on your behalf ("Projects") belongs to you, and you shall be the sole owner of the copyright for all Projects. In the event that any operation of law would cause 3am Studio to become the owner of a Project, in whole or in part, 3am Studio irrevocably and perpetually assigns its entire interest in the Project to you, without limitation.
You warrant that any and all materials provided to 3am Studio as examples or as material to be incorporated into a project during the design process are owned by you and do not infringe on or misappropriate any third party's rights, including, but not limited to, all intellectual property rights and any right of publicity.
The service includes one week of revisions. You agree to provide clear and timely feedback during this period to ensure the final design meets your requirements.
Payment of $990 is required upfront before work begins. Refund requests are assessed on a case-by-case basis. 3am Studio reserves the right to deny refunds based on its own discretion.
3am Studio shall not be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of our services.
These Terms shall be governed and construed in accordance with the laws of [Your State/Country], without regard to its conflict of law provisions.
